1. Who can sell
1.1. You may sell on the Platform as a private individual if you are a natural person with full legal capacity aged 18 or over.
1.2. You may sell your own personal belongings. Buying goods for resale, regular trading and providing services are economic activity; in that case you must register as a person carrying out economic activity and conclude the Seller Cooperation Agreement for legal entities.
1.3. If the number of your transactions in a calendar year reaches 30 or their total reaches 2 000 EUR, we send you an informative reminder about a possible obligation to register an economic activity. The reminder is not tax advice; you are responsible for your own status.
1.4. You are responsible for paying tax on income earned on the Platform. Selling personal used belongings does not usually create a personal income tax liability if you have owned the item for more than 12 months and did not buy it for resale, but the final assessment is made by the Valsts ieņēmumu dienests (State Revenue Service).
2. Your relationship with the Buyer
2.1. You conclude the sale contract directly with the Buyer. IZSOLI.LV SIA is an intermediary and is not a party to the sale contract.
2.2. As you are not a trader, the Buyer does not have the consumer right of withdrawal within 14 days. The transaction is governed by the provisions of the Civillikums (Civil Law) on purchase. The item page clearly tells the Buyer that the seller is a private individual.
2.3. You are responsible for ensuring that the item matches its description and stated condition, and for hidden defects that you knew or should have known about.
2.4. You confirm that the item is your property, that it is not stolen, pledged or encumbered and that its sale is not prohibited.
3. Listing an item
3.1. State the true condition of the item using the Platform's condition scale (explanation: izsoli.lv/conditions) and add at least 3 photos showing the actual item. Photograph and describe each defect separately.
3.2. You must not use other people's photos, manufacturer catalogue images or images from other listings.
3.3. You must not offer goods from the List of Prohibited Items, which is attached to the Seller Cooperation Agreement and published on the Platform.
3.4. You must not bid in your own auction, ask others to do so or use several accounts.
3.5. You must not divert a transaction outside the Platform.
4. Fees
4.1. The commission fee is 10 % of the item's sale price, at least 1,00 EUR per item. The commission fee is the same for private individuals and traders.
4.2. Other fees (for listing, highlighting and storage) are set out in the Platform's Price List. Listing is free of charge for the first 3 months after registration.
4.3. We may amend the Price List by notifying you 15 days in advance. For items already listed, the previous Price List applies until the end of the auction.
4.4. The Platform reserves the right to introduce a subscription fee for maintaining an account in the future, giving 15 days' notice. No such fee applies when these terms enter into force.
5. Payment and payout
5.1. You authorise IZSOLI.LV SIA to accept payment for your goods on your behalf. Payment by the Buyer to the Platform counts as payment to you.
5.2. The payout is made to the account you specify within 3 working days after the Buyer confirms receipt of the item, or 14 days after confirmation of dispatch if no confirmation has been given and there is no complaint.
5.3. Minimum payout amount - 10,00 EUR. A smaller amount is carried over to the next period or paid out at your request.
5.4. The payout may be withheld if a complaint from the Buyer has been received or fraud is suspected, until the circumstances are clarified, but for no longer than 60 days.
5.5. The payout account must be in your name. Payouts to a third party's account are not made.
6. Dispatching the item
6.1. Dispatch the item within 3 working days of being notified that payment has been received and enter the tracking number on the Platform.
6.2. Pack the item so that it is not damaged in transit. You are responsible for damage caused by inadequate packaging.
6.3. If the Buyer files a complaint, reply to it within 14 days in the Platform's messaging section.
7. Tax reporting (DAC7)
7.1. You provide and keep up to date the following information: first name and surname; residential address; personal identity number; taxpayer identification number and its issuing country; country of residence; bank account number and account holder name.
7.2. As an operator of an online platform, we report this information and transaction data to the Valsts ieņēmumu dienests (State Revenue Service) in accordance with Council Directive (EU) 2021/514 (DAC7) once a year, by 31 January.
7.3. If the information is not provided after two reminders, we may withhold payouts and close your account.
8. Contractual penalties and account blocking
8.1. For breaches of these terms, contractual penalties apply in the amounts set out in Section 11 of the Terms of Use. Before a penalty is applied, you are given the opportunity to provide an explanation within 5 working days.
8.2. Your account will be blocked for offering prohibited items, bid manipulation, diverting transactions outside the Platform and repeated breaches.
9. Term of these terms
9.1. These terms apply for an indefinite period. You may close your account at any time, provided there are no outstanding transactions.
9.2. We may amend these terms by giving 15 days' notice. If you do not agree with the amendments, you may close your account.
9.3. The laws of the Republic of Latvia apply.
